iSellTZ Terms of Service

1. Introduction

These Terms of Service govern access to and use of iSellTZ, including its website, progressive web application, accounts, listings, communication features, verification features, and related services.

iSellTZ is operated by Genieforthenewworld, of Dar es salaam.

In these Terms:

  • “iSellTZ,” “we,” “us,” or “our” means the operator of the Platform.
  • “Platform” means the iSellTZ website, application, services, and associated systems.
  • “User” or “you” means any person who accesses or uses the Platform.
  • “Lister” means a user who advertises a product, vehicle, property, business offering, or other permitted item.
  • “Listing” means content published to advertise an item or opportunity.
  • “Buyer” includes a prospective buyer, tenant, customer, or other person responding to a listing.

By accessing the Platform, creating an account, publishing a listing, contacting another user, or selecting an option indicating acceptance, you agree to these Terms and the iSellTZ Privacy Policy.

Do not use the Platform if you do not agree to these Terms.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to create an account or publish a listing.

By using iSellTZ, you represent that:

  • The information you provide is truthful;
  • You have legal capacity to accept these Terms;
  • You are not prohibited by law from using the Platform; and
  • Where you act for a business or another person, you have authority to bind that business or person.

We may request reasonable evidence of age, identity, authority, ownership, or business status.

3. Nature of the Platform

iSellTZ provides technology that allows users to publish, discover, and respond to marketplace listings.

Unless a particular service expressly states otherwise:

  • iSellTZ is not the owner, seller, landlord, property agent, vehicle dealer, manufacturer, buyer, tenant, employer, financier, insurer, or guarantor of listed items;
  • iSellTZ is not a party to agreements made between users;
  • Users negotiate and complete transactions independently;
  • iSellTZ does not receive or hold purchase money, deposits, rent, booking fees, or transaction funds on behalf of users;
  • iSellTZ does not guarantee that a transaction will be completed; and
  • iSellTZ does not provide legal, financial, valuation, mechanical, property, tax, or investment advice.

A listing is an advertisement, not a guarantee by iSellTZ.

4. User Accounts

You may be required to create an account to publish listings or use certain features.

You agree to:

  • Provide accurate and current information;
  • Maintain only accounts that you are authorised to use;
  • Keep account information updated;
  • Protect your login credentials and devices;
  • Not permit unauthorised access to your account;
  • Notify us promptly of suspected compromise; and
  • Accept responsibility for activity conducted through your account unless caused directly by our failure to apply reasonable security.

You may not:

  • Create an account using another person’s identity without authority;
  • Sell, transfer, rent, or share an account;
  • Create accounts to evade suspension;
  • Use automated tools to create accounts;
  • Impersonate iSellTZ, another user, a business, or a public authority; or
  • Misrepresent your location, role, ownership, or professional status.

5. Google Sign-In

iSellTZ may allow users to create or access an account using Google Sign-In.

When you use Google Sign-In:

  • Google authenticates your Google account;
  • iSellTZ may receive basic account information permitted by you;
  • iSellTZ does not receive your Google password;
  • Your use of Google services remains subject to Google’s terms and policies; and
  • Disconnecting Google access may prevent you from signing in through Google unless you configure another supported login method.

You remain responsible for protecting your Google account.

Google is an independent service provider and is not responsible for listings, transactions, users, or services offered through iSellTZ.

6. Listing Requirements

A Lister must have the legal right and proper authority to advertise every listed item.

Each Listing must:

  • Be accurate and not materially misleading;
  • Be placed in the correct category;
  • Describe the actual item or opportunity being offered;
  • Use photographs that fairly represent the listed item;
  • State the genuine price or pricing basis;
  • Disclose significant defects or restrictions known to the Lister;
  • Include lawful contact information;
  • Comply with applicable laws and professional obligations;
  • Avoid hidden conditions or deceptive charges; and
  • Be updated or removed when no longer available.

7. Property and Rental Listings

A person advertising real estate or rental property represents that they:

  • Own the property or have authority from the owner to advertise it;
  • Have accurately described the property and its availability;
  • Have disclosed material restrictions or charges;
  • Will not demand money through fraudulent or misleading representations;
  • Will not unlawfully discriminate against prospective tenants or buyers;
  • Will comply with applicable land, housing, agency, taxation, and local-authority requirements; and
  • Will not advertise property that does not exist or is not genuinely available.

Prospective buyers and tenants should independently inspect the property, verify ownership or authority, examine relevant documents, understand applicable charges, and obtain professional advice before making payment or signing an agreement.

8. Vehicle Listings

A person advertising a vehicle represents that they:

  • Own the vehicle or have authority to advertise it;
  • Have accurately stated the vehicle’s condition and specifications;
  • Have not deliberately concealed accident, mechanical, mileage, financing, customs, registration, or ownership information;
  • Will disclose known material defects;
  • Will provide genuine documents where legally required; and
  • Will comply with applicable vehicle, licensing, taxation, registration, importation, and road-safety laws.

Prospective buyers should independently inspect the vehicle, verify ownership and registration, check applicable records, and obtain a qualified mechanical inspection before payment.

9. Business and Product Listings

A retailer, business, or other commercial Lister represents that:

  • The business and products are lawful;
  • Product descriptions and prices are accurate;
  • Required licences, approvals, and registrations are maintained;
  • Products are genuine and legally acquired;
  • Safety information is disclosed where relevant;
  • Intellectual-property rights are respected; and
  • Applicable consumer, tax, trade, labelling, and advertising requirements are followed.

10. Prohibited Listings and Conduct

You must not use iSellTZ to advertise, promote, request, distribute, or facilitate:

  • Stolen property;
  • Counterfeit or pirated goods;
  • Fraudulent or nonexistent property, vehicles, products, businesses, or services;
  • Items you have no authority to sell, rent, or advertise;
  • Illegal drugs or controlled substances;
  • Unlawful weapons, explosives, or dangerous materials;
  • Human trafficking, exploitation, or unlawful sexual services;
  • Wildlife or environmental contraband;
  • Forged documents;
  • Financial scams, pyramid schemes, or fraudulent investments;
  • Malware, stolen accounts, hacking services, or unlawful surveillance tools;
  • Content infringing intellectual-property rights;
  • Hate, threats, harassment, or unlawful discrimination;
  • Obscene or exploitative content;
  • Personal data obtained without lawful authority; or
  • Any item, service, or conduct prohibited by applicable law or iSellTZ policy.

You must not:

  • Scrape or harvest Platform data without permission;
  • Interfere with Platform security;
  • Introduce malware or harmful code;
  • Manipulate search, ranking, reviews, or engagement;
  • Send spam or repeated unsolicited messages;
  • Use automated systems without written authorisation;
  • Attempt to obtain another user’s password or verification code;
  • Circumvent moderation, restrictions, or technical controls; or
  • Use iSellTZ to facilitate fraud, money laundering, or other unlawful activity.

11. User Content

You retain ownership of content you lawfully submit to iSellTZ.

By uploading or publishing content, you grant iSellTZ a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, format, display, distribute, and technically adapt that content to:

  • Operate the Platform;
  • Display your Listing;
  • Make content compatible with different devices;
  • Promote the Listing or Platform;
  • Prevent fraud and enforce these Terms; and
  • Maintain reasonable backups and records.

This licence ends when the relevant content is deleted, except where continued retention is necessary for backups, legal compliance, security, dispute resolution, or evidence of a violation.

You represent that:

  • You own the content or have permission to use it;
  • The content does not infringe another person’s rights;
  • Persons shown in uploaded media have been included lawfully;
  • The content is not deceptive or unlawful; and
  • Publication does not breach confidentiality or data-protection obligations.

12. Verification and Badges

iSellTZ may display designations such as verified landlord, verified retailer, verified dealer, verified agent, verified business, or similar badges.

A verification badge means only that iSellTZ completed the checks described for that particular verification process at the time of review.

Verification does not guarantee:

  • Honesty or future conduct;
  • Ownership of every listed item;
  • Quality, condition, safety, or legality;
  • Ability to complete a transaction;
  • Financial standing;
  • Professional competence;
  • Accuracy of every statement;
  • Freedom from fraud; or
  • Endorsement by iSellTZ.

Users must continue to exercise independent judgment and due diligence.

We may refuse, suspend, revoke, or require renewal of verification where information is incomplete, inaccurate, expired, misleading, disputed, or inconsistent with our requirements.

13. User Transactions and Safety

Users communicate, negotiate, inspect, contract, and exchange money at their own discretion.

Before completing a transaction, users should:

  • Meet in a safe and appropriate location;
  • Inspect the item;
  • Verify the identity and authority of the other party;
  • Review original documents;
  • Avoid advance payment where legitimacy is uncertain;
  • Use traceable and lawful payment methods;
  • Obtain written agreements and receipts;
  • Seek qualified legal, mechanical, property, or financial advice where appropriate; and
  • Report suspicious conduct.

iSellTZ cannot guarantee that a user will perform an agreement or return money.

A dispute between users must ordinarily be resolved between those users. We may provide reasonable account or listing records where lawful, but we are not obliged to act as an arbitrator, debt collector, or enforcement authority.

14. Fees and Paid Services

Some iSellTZ services may be free, while others may require payment.

Where a fee applies:

  • The applicable price and service will be displayed before purchase;
  • You are responsible for applicable taxes and third-party charges;
  • Fees are not refundable except where required by law or expressly stated;
  • Promotional services do not guarantee views, enquiries, or completed transactions; and
  • We may change future prices without changing a service already purchased.

Payments made directly between marketplace users are not fees paid to iSellTZ.

15. Communications and Notifications

By providing contact information, you agree that iSellTZ may send:

  • Account-verification messages;
  • Login and security alerts;
  • Listing updates;
  • Responses to support requests;
  • Moderation and enforcement notices;
  • Operational service announcements; and
  • Marketing messages where permitted.

You may opt out of marketing, but not communications necessary for security, legal compliance, account administration, or delivery of requested services.

Users must not misuse another user’s contact details or send unlawful, threatening, deceptive, or unsolicited communications.

16. Moderation and Enforcement

iSellTZ may review, restrict, reject, edit for formatting, hide, suspend, or remove content where we reasonably believe that it:

  • Violates these Terms;
  • Is unlawful;
  • Is misleading or fraudulent;
  • Creates a safety or security risk;
  • Infringes another person’s rights;
  • Has been reported and requires investigation;
  • Is duplicated, expired, irrelevant, or incorrectly categorised; or
  • Could harm the Platform or its users.

We may warn, restrict, suspend, or terminate an account where the user:

  • Repeatedly violates these Terms;
  • Provides false verification information;
  • Engages in suspected fraud;
  • Creates risk to users;
  • Attempts to evade restrictions;
  • Misuses Platform data; or
  • Exposes iSellTZ to legal or security risk.

We may preserve relevant records and cooperate with competent authorities where lawful.

Although we may moderate content, we are not required to inspect every Listing before publication. The presence of a Listing does not mean that iSellTZ has approved or verified it.

17. Reporting Violations

Users may report suspicious accounts, prohibited listings, intellectual-property infringements, fraud, harassment, or other violations through the available reporting function or by contacting [SUPPORT EMAIL ADDRESS].

A report should contain enough information to identify the relevant account or Listing and explain the concern.

Submitting a false, malicious, or abusive report may itself violate these Terms.

18. Intellectual Property

The iSellTZ name, logo, Platform design, software, interfaces, databases, text, and original materials are owned by or licensed to [LEGAL NAME] and are protected by applicable intellectual-property laws.

Except as expressly permitted, you may not:

  • Copy or reproduce substantial parts of the Platform;
  • Use the iSellTZ brand without permission;
  • Reverse engineer or interfere with Platform software;
  • Create a confusingly similar service or identity;
  • Republish Platform data commercially; or
  • Remove ownership, copyright, or trademark notices.

19. Third-Party Services and Links

The Platform may integrate or link to Google, map providers, messaging services, payment providers, social networks, or other third-party services.

iSellTZ does not control independent third-party services and is not responsible for their:

  • Availability;
  • Security;
  • Content;
  • Prices;
  • Representations;
  • Data practices; or
  • Performance.

20. Platform Availability and Changes

We aim to keep iSellTZ reasonably available but do not guarantee uninterrupted or error-free operation.

The Platform may be unavailable because of:

  • Maintenance;
  • Software updates;
  • Internet or hosting failures;
  • Security incidents;
  • Third-party service outages;
  • Legal requirements; or
  • Circumstances beyond our reasonable control.

21. Disclaimers

The Platform and its content are provided on an “as available” basis.

To the maximum extent permitted by law, iSellTZ does not warrant that:

  • Every user is genuine;
  • Every Listing is accurate;
  • Listed items are safe, legal, available, or fit for purpose;
  • Verification documents are authentic;
  • A user will honour an agreement;
  • The Platform will always be uninterrupted;
  • Errors will always be corrected immediately; or
  • Use of the Platform will produce a particular commercial result.

Nothing in these Terms excludes a warranty, obligation, or consumer right that cannot lawfully be excluded.

22. Limitation of Liability

To the maximum extent permitted by law, iSellTZ will not be responsible for indirect, incidental, consequential, special, punitive, or economic losses arising from:

  • User conduct;
  • A Listing;
  • A transaction between users;
  • Loss of profit or opportunity;
  • Fraud committed by another user;
  • Defects in listed items;
  • Property or vehicle disputes;
  • External communications;
  • Third-party services; or
  • Unauthorised account access not caused by our failure to apply reasonable security.

Where iSellTZ is legally liable and liability may lawfully be limited, our aggregate liability relating to a paid service will not exceed the amount paid directly to iSellTZ for the specific service giving rise to the claim during the six months preceding the event.

This clause does not limit liability that cannot legally be limited, including liability arising from fraud, wilful misconduct, or other liability protected by mandatory law.

23. Indemnity

To the extent permitted by law, you agree to compensate iSellTZ for reasonable losses, liabilities, penalties, damages, and legal costs resulting from:

  • Your unlawful use of the Platform;
  • Your Listing or User Content;
  • Your infringement of another person’s rights;
  • Your fraud or misrepresentation;
  • Your breach of these Terms; or
  • A transaction or dispute arising from an item you advertised.

24. Account Termination

You may stop using iSellTZ at any time and may request account deletion in accordance with the Privacy Policy.

We may suspend or terminate access where reasonably necessary to:

  • Enforce these Terms;
  • Prevent fraud or abuse;
  • Protect users;
  • Comply with law;
  • Address security risks; or
  • Protect iSellTZ’s legitimate interests.

Termination does not remove obligations or liabilities that arose before termination. Clauses concerning intellectual property, user disputes, liability, indemnity, governing law, and retained records survive termination where relevant.

25. Privacy

Our collection and processing of personal data are governed by the iSellTZ Privacy Policy.

By using the Platform, you acknowledge that you have had an opportunity to review that policy.

26. Changes to These Terms

We may update these Terms when necessary to reflect:

  • Changes to the Platform;
  • New features;
  • Legal or regulatory developments;
  • Security requirements; or
  • Business and operational changes.

Updated Terms will display a revised “Last updated” date.

Where a material change significantly affects existing users, we will provide reasonable notice. Continued use after the change takes effect constitutes acceptance, except where applicable law requires express consent.

27. Governing Law and Disputes

These Terms are governed by the laws of the United Republic of Tanzania.

Before commencing formal proceedings, a user should first send a written description of the dispute to [Genienewworld@outlook.com] and allow a reasonable opportunity for resolution.

Where the dispute cannot be resolved informally, it may be submitted to a court or competent authority in Tanzania, subject to any mandatory rights or procedures provided by law.

28. General Provisions

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will continue to apply.

Failure by iSellTZ to enforce a provision immediately does not waive the right to enforce it later.

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations as part of a lawful reorganisation, acquisition, or transfer of the Platform.

These Terms, together with the Privacy Policy and any additional terms displayed for a particular paid service, form the agreement between you and iSellTZ concerning use of the Platform.
